      平成28～30年度JSPS科学研究費助成事業基盤研究（C）課題番号16K04202として実施した研究の報告書として研究成果をまとめた。
      本研究では、法律と社会福祉の架橋と言われてきた成年後見制度を取り上げ、さらに成年後見制度を福祉サービスの利用のために不可欠とした福祉の「契約」の実態に迫り、これらのしくみが本来目指していた利用者の「権利」を護り、利用者と事業者を対等の位置に据えることに寄与したのかという問題を明らかにすることを目指して研究に取り組んだ。
      このような研究課題に対し、政府資料や先行調査を検討し、主に障害当事者や家族、行政関係者等へのインタ
      ビューを行った。
      研究の結果、権利擁護の概念は未整理であり、現行の契約制度も十分な共通理解がなされないままに実施されていた。さらに、意思決定支援に関する理解に混乱が起こっている状況が明らかになった。

      本研究は、法学と社会福祉学の接点に位置する成年後見制度を批判的に検討し、判断能力が不十分である人々と周囲との関係性を軸に、新たな権利の捉え直しを意図する。
      まず、禁治産の時代から現在に至る経緯を、文献研究により検証し、民法は判断能力の不十分な人々をどう捉え、障害者権利条約における意思決定支援への転換に、如何なる社会的理論が存在したのかを見極める。諸外国の制度を参照し、社会保障制度との関係を考察する。自立／自律と保護、支援の関連を、本人の主体性を重視しつつ論点整理を行う。
      次に、成年後見制度の対象となる本人・家族や当事者団体、制度の普及や基盤整備に当たる行政・社協・専門職能団体等にヒアリング調査を行い、問題点・課題の分析を進める。
      最後に研究成果を統合し、日本独自の文化的背景や特性を考慮した上で、社会福祉分野における判断能力の不十分な人々の新たな「権利擁護システム」のモデル構築を示す予定である。

      昨今、高齢者介護を筆頭に、社会福祉の支援を担う優れた人材養成の必要性が指摘されているが、現実には最低限の人材確保さえ難しい状況が続いている。背景には、人口構造の変化やニーズの多様化、福祉職への偏ったイメージ等が複雑に絡み合い、抜本的解決を図ることは難しいのが現実である。
      福祉事業者を組織化してきた全国社会福祉協議会（全社協）でも総合的な人材確保・定着に向けた各種取り組みを実施してきたが、福祉人材に共通する課題として①必要な福祉人材の中長期的安定的確保、②福祉にふさわしい人材育成の必要性、③継続労働が可能な職場環境の整備（全社協2016）が指摘されている。
      本プロジェクトは、上記の「福祉にふさわしい人材」に注目し、具体的にどのような資質や専門性が必要であり、どのような方法を用いれば求められる人材育成が可能になるのかを明確化するために、福祉現場で働いている人々自身が考える人材像と教育方策を、ヒアリング調査により探索的に導き出すパイロット研究を実施する。
