    2023年度には主にデジタル経済における競争法による規律と直接規制の適切な組み合わせについて検討した。欧州で施行されたデジタル市場法（DMA）は、規制対象となる企業の多様性につりあいをとる形で規制内容がかなり複雑化する傾向にある。このような状況のもと、デジタル経済における競争政策はますます複雑で動態的な視点が求められている。
    特に注目した事案として、2023年に米国で訴訟の進展が見られたEpic GamesによるAppleやGoogleに対する訴訟を詳細に検討した。例えば、モバイル・エコ・システムにおけるアプリストアにみられる「アウトリンク」（アプリストア以外の外部決済システムへと誘導すること）や「サイド・ローディング」（ブラウザ等を介してアプリストア以外からダウンロードすること）を禁じる取引慣行に風穴を開けようとする訴訟や、代替的なアプリの流通経路や決済システムをアプリストア側に認めさせようとする事前規制の動きが各国に広がっている。これらの動きに対する競争当局や規制当局の担当者との意見交換の機会を設けてメンバーの理解の深化と共有化を図った。さらに、2024年1月に大阪公立大学およびASCOLA Asiaとの共催による国際シンポジウム（Digital Regulation in Korea and Japan: Comparative Studies and Dialogue）を開催し、韓国と日本の規制や欧米の規制動向の比較検討を行った。
    これらの検討を通じて明らかとなったのは、デジタルプラットフォームのビジネスモデルに見られるバンドリング（bundling）のような行為類型の違法性の判断が極めて難しい課題として浮上していることである。バンドル・ディスカウントのような複雑な条件付価格設定は技術的にますます容易になっており、その違法性の判断を難しくしている。

    2021年度はコロナ禍が続いたために対面の研究会は行わず、オンラインによる研究会・意見交換を中心に行った。グローバルなデジタル経済におけるサプライチェーンに対する規制目的や違法性の判断基準を明確にすることは、合理的・整合的な競争政策を推進するために不可欠である。そこで、デジタル経済の文脈のなかで市場支配力の行使と厚生基準の関係を法的・経済学的に検討した。
    特にデジタル経済における競争政策の動向として注目されるのは、事前規制と事後規制を事業者の自主規制と融合させる共同規制の導入が進みつつあることである。共同規制のメリットは、競争法による重い手続き（市場画定、反競争行為の認定、排除措置命令）に依らず、迅速かつ柔軟に事業者との協力関係を維持しつつ実効的な規制を実現できる点にある。
    しかし、本研究プロジェクトの検討を通じて、共同規制が競争政策と整合的に機能するためには、なお多くの課題があることが明らかとなった。例えば、規制対象を一部事業者に限定する適切な仕組みを設けること、事前規制に係る行動規範を的確かつ柔軟に設けること、違法性の判断は事前的な衡平性の原則に従うべきこと、デジタル経済の技術変化を考慮した動学的資源配分に配慮するべきことなどである。
    これらの検討をベースとして、さらに最新動向に関わる文献調査を行い、デジタル経済における独禁法事件の事例の検証を行った。特に、オンライン・モール、アプリストア、クラウドサービスにおける様々な紛争事例に関する情報収集を行い、メンバー間で事例研究や文献情報の共有や意見交換を行った。さらに、デジタルプラットフォームに対する規制を所管する経済産業省、公正取引委員会の担当者と意見交換を行い規制政策の最新動向の情報収集を行った。

    本研究は、デジタル経済の進展によってインターネット上で商品に関する情報を発信することが容易化し、様々な課題が生じている今日の広告規制のあり方の解明を目指している。
    以上の研究目的を達成するため、2021年度には、第一に、米国・連邦取引委員会（FTC）によるステルス・マーケティングに対する規制に関する調査を行った。FTCは、ステルス・マーケティングに関して活発な規制を行っていることで知られ、膨大な公表資料が存在する。そこで、FTCの先例、指針、指針改定時におけるパブリックコメントに対するコメント等を調査対象として分析を行い、FTCの考え方を整理しつつ、実際にはどのような事例において、誰を名宛人として立件しているのかを分析した。
    また、第二に、2022年度以降に計画していた広告主以外に対する規制をめぐる問題に関連して、プラットフォームの不当表示に係る責任に関する検討を前倒しで行った。プラットフォームが不当表示に関わるケースでは、不当表示のもたらす弊害がより大きくなりうる一方で、日本の景表法では規制上の障害が存在する。他方、米国やオーストラリアにおいては、プラットフォームに対する規制も行われている。2021年10月に商事法務独禁法研究会で報告の機会を与えられたことから、米国とオーストラリアの事例検討を行い、参加メンバーである研究者や実務家から有益なコメントを受けることができた。その成果は、雑誌「公正取引」において公表している。
