  • 主に心理学（特に社会心理学や進化心理学）の理論・方法を参考にしながら、量刑判断やその評議過程、刑事法に関連する世論の研究を行ってきた。また、刑事法分野だけでなく、弁護士へのアクセスや民事裁判に関する法社会学的な研究にも関わっている。実証的な知見を基盤としながら、法制度や法運用に関する政策的提言を行うことを目的とした研究を行っている。

      This study verified the influence of a punishment reference histogram on the sentences of lay judges. In Experiment 1, 80 undergraduates determined the prison terms of an offender in an audio trial. About half the students were shown a histogram with a peak of the punishment meted out in similar cases and the remainder a histogram without it. The peak was set as a relatively short prison term (5–10 yrs) considering the seriousness of the crime (murder). The result indicated that the peak-histogram group chose significantly shorter prison terms than did the non-peak-histogram group, suggesting that the peak influenced the former's sentencing. Moreover, Experiment 2 showed that the peak of the histogram influenced participant sentencing more strongly than a table, although both held the same punishment data, and that the same shaped histogram of different data did not. From these results, we concluded that the anchoring effect of the histogram is most likely to be caused by the visual attractiveness of the peak.

      Recently, the Code of Criminal Procedure has been revised to introduce the Victims' Statement of Opinion and the Victim Participation System. These systems enable greater involvement of crime victims in criminal trials than previously permitted. This study addresses victims' perception regarding their participation in criminal trials. On this issue, there exists empirical research of Victim Impact Statements (VIS) in common law countries. This study reviews these researches and discusses the inconsistency in the research objectives. Early studies focused on whether VIS improves victim satisfaction. However, subsequent studies addressed the victims' reaction to VIS. The author suggests that the objective of victim participation should be clarified. It also analyzes these studies from the perspective of the social psychology of procedural justice. The emphasis of this theory has moved from characteristics of various processes to interpersonal relationships within a process. This study uses this perspective to interpret the findings of existing studies and points out the necessity for empirical research in Japan as well as issues that need further exploration.

      Since 2000, the Japanese Code of Criminal Procedure has been revised twice to introduce into criminal trials two systems of victim participation: the Victim's Statement of Opinion (VSO) and the Victim Participation System. This study addresses the impact of those systems on decision-making in criminal trials, with special focus on the impact on sentencing. Following a literature review are the early findings from my psychological experiment which focuses on sentencing by lay judges. The results indicate that information concerning crime victims does have an impact on sentencing, but it is immaterial whether or not the information is submitted through recently introduced systems. Evaluations of those systems from the perspectives of crime victims also indicate that they tend to evaluate at least the VSO positively, regardless of the statements' perceived lack of impact on the outcome.
