    • Freedom of Expression in Japan, Artistic Work and Legal Interpretation

      More details

      Grant type:Competitive

This research project seeks to understand how Japanese courts imposed limitations on artistic expression considering codified limitations - such as Article 175 of the Criminal Code - and freedom of expression as a constitutionally protected right enshrined in Article 21 of the Constitution. To circumvent constitutional constraints, limitations on artistic work are mainly twofold: criminal (no obscenity allowed) and self-made (through representative organizations).
The current research seeks to understand how courts limit artistic works such as "Chatterley’s Lover", "In the Realm of the Senses", and "Mapplethorpe". Moreover, this research project also analyzes the work of self-censoring organizations.

    • Treaty Interpretation before International Courts

      More details

      Grant type:Competitive

This research seeks to analyze how the Inter-American Court of Human Rights and the European Court of Human Rights interpret their respective treaties and apply them in concrete cases. The specific focus is when Courts deal with issues concerning minorities (e.g., gender minorities, religious minorities, indigenous peoples), when there is no consensus on interpretation, and when the issue before the court does not have a clear answer in the treaty.
This research follows a legal analysis of case laws, doctrine, and jurisprudential discussions on treaty application and interpretation.

    • Ideas of of Law, Justice and Peace in Pop Culture

      More details

      Grant type:Competitive

The current research has four main aspects: 1. Understand Shotaro Ishinomori's concept of justice and peace in his main written works from the 1970s (namely: Gorenger, Kamen Rider, and Kikaider); 2. Understand how Ishinomori's concepts were translated into television shows (as “tokusatsu”); 3. Understand how tokusatsu fans understand these concepts and allegories from Ishinomori-based shows; 4. How tokusatsu fans relate with peace and justice in their own lives - based on the writing works of manga artist Tanba Niwa.
This research project follows and analytical and empirical methodologies. The analytical works seek to understand concepts of peace and justice in the original works of Ishinomoru Shotaro and their television adaptation. The empirical work comprises semi-structural interviews with adult tokusatsu fans from Japan and abroad.
