    ABSTRACT: As AI increasingly automates hiring decisions, organizations worldwide face growing legal challenges to confront algorithmic bias and ensure fair employment practices. Corporate leaders, in-house counsel, HR departments, and AI vendors must act now or risk regulatory penalties, costly litigation, and reputational harm.

    In the US, Workday, a global HR software vendor, faces a collective action lawsuit after a Black applicant alleged that its AI screening tools discriminated against him based on race, age, and disability. The case tests traditional anti-discrimination in the US Employment Act of 1967, in novel AI contexts. Courts are considering whether AI vendors may act as ‘agents’ of employers, which could broaden liability to companies using such platforms. Meanwhile, New York City’s Local Law 144 mandates annual third-party bias audits of automated employment decision tools, while Illinois’ AI Video Interview Act and Maryland’s Facial Recognition Services Law add further compliance layers.

    The EU’s AI Act classifies employment-related AI systems as “high-risk,” requiring risk assessments, data quality, human oversight, and post-deployment monitoring, with noncompliance carrying serious regularity risks. Civil society adds scrutiny: for example, privacy nonprofit organization, noyb, alleged Amazon misused its automated hiring systems, violating EU transparency and fairness standards.

    Japan’s new “soft law” AI strategy favors innovation but does not shield companies from cross-border compliance obligations. Proactive AI governance teams, fairness safeguards, and an action plan for risk assessment, data analysis, bias auditing, and monitoring offer practical paths forward. As tolerance for opaque algorithmic decisions fades, companies should embrace accountability and responsible AI governance globally.

    Abstract: The year 2025 marks a full century since pre-World War II Japan passed the Peace Preservation Law. Initially framed as a national stability measure, the law now symbolizes the totalitarianism of Japan’s Imperial regime. The Justice Ministry designated violations as “thought crimes,” and “thought procurators” assigned to the “thought bureau” prosecuted alleged violators. By 1928, mass arrests targeted the Japanese Communist Party and “anti-government” journalists. The Peace Preservation Law laid part of the groundwork for martial law-like deprivations of corporate decision making and private rights in wartime Japan. Thus, on this occasion of the law’s centenary, examining Japan’s evolution in balancing state power against corporate and private rights is apt, particularly given modern concerns about media freedom and a military now capable of “proactive contribution[s] to peace." Japan’s history suggests that while security exigencies may give rise to (potentially/hopefully) temporary constraints on rights – as Ukraine now faces under martial law – the post-conflict restoration, protection, and even championing of such rights remain crucial for sustainable economic recovery and democratic governance.

    Abstract: Capital punishment deliberations present a troubling constitutional crisis when jurors engage in religious discussions that fundamentally alter the basis for life-or-death decisions. The problematic intersection of religious discourse and death penalty sentencing undermines the fairness and reliability of capital punishment decisions by introducing arbitrary theological considerations that have no place in legal proceedings governed by statutory aggravating and mitigating factors.

    Focusing on Young v. State, a trial during which jurors allegedly brought a Bible into deliberations and read passages from Romans and Psalms that influenced their recommendation of a death sentence, the analysis demonstrates how religious discourse can transform ostensibly rational death penalty proceedings into what Justice Brennan termed a "lottery system." When jurors debate competing biblical mandates such as Old Testament retribution ("eye for eye, tooth for tooth") against New Testament calls for mercy and forgiveness, a defendant's ultimate fate may depend entirely on which theological faction prevails rather than on careful weighing of legally relevant evidence. Such religious discussions constitute "extraneous material" that violates due process and equal protection guarantees while rendering death sentences constitutionally arbitrary.

It traces the evolution of legal practice from siloed transactional work to engagement with complex intersections of ESG compliance, human rights due diligence, AI governance, and geopolitical risk under expanding cross-border regulatory regimes. Through personal narratives, including an air-raid interruption during an online lecture to students based in Odesa, Ukraine, and participation in Ukraine's 7th International Scientific and Practical Conference on balancing private rights and public interest under martial law, the essay argues that rigorous, values-driven legal education functions as a quiet act of resistance and international solidarity in times of global crisis.

    This presentation, “Foreign Corrupt Practices Act (FCPA) Enforcement: The Pause, Restart, and New ‘America First’ Era,” traced the FCPA’s evolution from its post-Lockheed scandal origins in 1977 through dormancy in the 1980s and its 1990s reinvention as a global anti-bribery blueprint influencing the OECD Anti-Bribery Convention, the UK Bribery Act, and France’s Sapin II. The presentation then analyzed President Trump’s February 2025 executive order pausing FCPA enforcement for 180 days and the subsequent June 2025 Justice Department guidelines that restarted enforcement with a fundamentally reoriented mission. The new approach prioritizes American economic competitiveness and national security, focusing enforcement on cases where bribery by foreign competitors harms identifiable U.S. companies. This shift from universal anti-corruption principles to transactional ‘America First’ enforcement represents a significant departure from nearly five decades of FCPA practice, with implications for corporate compliance teams, international cooperation, and the broader global anti-corruption architecture. The lecturer closed with a prediction of similar reorientations in other extraterritorial regulatory domains, including data flows and digital governance.

    This presentation, “When Algorithms Take the Witness Stand: AI as Evidence and AI on Trial,” examined how artificial intelligence (AI) is transforming both evidentiary practice and accountability in law. The first half described three distinct forms of AI evidence -- AI-enhanced, AI-derived, and AI-generated -- and the challenges each poses to evidentiary reliability and judicial gatekeeping. It highlighted how courts, regulators, and corporate actors across jurisdictions differ in how they assess the trustworthiness of AI in general and AI evidence in particular: Japan relies on procedural harmony and administrative guidance reinforced by reputational pressures; the European Union adopts precautionary regulatory oversight and ex ante certification; and the United States uses adversarial testing via ex post litigation, which may soon incorporate AI-generated outputs as "expert witness" testimony under proposed Federal Rule of Evidence 707. The second half turned to AI itself as a potential defendant in copyright and product liability contexts, drawing on recent Character.AI litigation involving teen suicides to illustrate how doctrines of fault and foreseeability are evolving to address harm caused by autonomous systems.
