    Abstract: The year 2025 marks a full century since pre-World War II Japan passed the Peace Preservation Law. Initially framed as a national stability measure, the law now symbolizes the totalitarianism of Japan’s Imperial regime. The Justice Ministry designated violations as “thought crimes,” and “thought procurators” assigned to the “thought bureau” prosecuted alleged violators. By 1928, mass arrests targeted the Japanese Communist Party and “anti-government” journalists. The Peace Preservation Law laid part of the groundwork for martial law-like deprivations of corporate decision making and private rights in wartime Japan. Thus, on this occasion of the law’s centenary, examining Japan’s evolution in balancing state power against corporate and private rights is apt, particularly given modern concerns about media freedom and a military now capable of “proactive contribution[s] to peace." Japan’s history suggests that while security exigencies may give rise to (potentially/hopefully) temporary constraints on rights – as Ukraine now faces under martial law – the post-conflict restoration, protection, and even championing of such rights remain crucial for sustainable economic recovery and democratic governance.

    Abstract: Capital punishment deliberations present a troubling constitutional crisis when jurors engage in religious discussions that fundamentally alter the basis for life-or-death decisions. The problematic intersection of religious discourse and death penalty sentencing undermines the fairness and reliability of capital punishment decisions by introducing arbitrary theological considerations that have no place in legal proceedings governed by statutory aggravating and mitigating factors.

    Focusing on Young v. State, a trial during which jurors allegedly brought a Bible into deliberations and read passages from Romans and Psalms that influenced their recommendation of a death sentence, the analysis demonstrates how religious discourse can transform ostensibly rational death penalty proceedings into what Justice Brennan termed a "lottery system." When jurors debate competing biblical mandates such as Old Testament retribution ("eye for eye, tooth for tooth") against New Testament calls for mercy and forgiveness, a defendant's ultimate fate may depend entirely on which theological faction prevails rather than on careful weighing of legally relevant evidence. Such religious discussions constitute "extraneous material" that violates due process and equal protection guarantees while rendering death sentences constitutionally arbitrary.
